Biodata

Razlan have been in continuous legal practice since 1993, and is a founding partner of Messrs Gan, Ho&RazlanHadri, a firm he established in 1995. Razlan has extensive litigation experience, specializing in commercial and insurance cases, at different levels of courts, from conducting trials and at the Magistrates, Sessions and High Courts to arguing appeals at the High Court, the Court of Appeal and the Federal Court. He also is regularly appointed as Counsel by other firms of solicitors for cases at the High Court, Court of Appeal and the Federal Court. These cases involve issues pertaining to defamation, securities law, company law, contract, insurance, intellectual property, medical negligence and human rights. A number of his cases have been reported in the law journals.

In a recent case of the Federal Court, Razlan successfully argued that in a situation involving a concession agreement awarded by a state government to a company, termination of the same requires reasoned grounds by the state. He was one of the Counsel, in acting for a group of former ISA detainees in suing the police for unlawful detention where the Court of Appeal ordered one of the highest awards for damages ever given for this type of cases. The said decision has since, been upheld by the Federal Court.

Recently, at the Court of Appeal, he successfully acted for a director of a public listed company in a judicial review case against Bursa Malaysia Berhad, which upheld the principle that Bursa Malaysia cannot impose restitutionary remedies against directors of a public listed company.   He was also one of the counsel for the former Mentri Besar of Perak and former Speaker for the state assembly in the “Perak Constitutional Crisis” cases, where the Federal Court re-stated the principle of ascertaining confidence of the members of the state assembly in the sitting Mentri Besar. 

 

Currently, he is acting for directors of a subsidiary of a public listed company that are sued for alleged breaches of fiduciary duties in relation to the sale of a major water concession business.He had served on several committees of the Bar Council including, the Professional Indemnity Insurance Committee of the Bar Council, the initial Compendium of Award for Personal Injuries Committee, and the Judicial Appointments Commission Committee of the Bar Council. In the latter, he was directly involved in formulating and drafting the Malaysian Bar’s position on the Judicial Appointments Commission.

He is a member of the Disciplinary Committee Panel of the Advocates & Solicitors Disciplinary Board since 2014 and was a past member of the Compensation Fund panel of the Malaysian Bar. Razlan is also an accredited advocacy trainer for the Malaysian Bar and examiner for the Malaysian Legal Qualifying Board.
